公務人員陞遷法 第7條 各機關辦理本機關人員之陞任，應注意其品德及對國家之忠誠，並依擬陞任職務所需知能，就考試、學歷、職務歷練、訓練、進修、年資、考績（成）、獎懲及發展潛能等項目，訂定標準，評定分數，並得視職缺之職責程度及業務性質，對具有基層服務年資或持有職業證照者酌予加分。必要時，得舉行面試或測驗。如係主管職務，並應評核其領導能力。各機關職缺擬由本機關以外人員遞補時，得參酌前項規定訂定資格條件辦理之。依第一項所評定之積分有二人以上相同時，以較高職等或訓練進修及發展潛能積分較高者，排序在前。第一項標準，由各主管院訂定。但各主管院得視實際需要授權所屬機關依其業務特性定之。各機關辦理本機關人員之遷調，得參酌第一項規定，自行訂定資格條件之審查項目。
