20 Article 39-1 of the R.O.C. Customs Anti-smuggling Act states: “Where import or export cargoes, other thangenuine goods parallel imported, that have been declared to Customs infringes the patent right, trademark rightor copyright, the importer or exporter in question shall be, except otherwise specified in other acts andregulations, imposed with a fine equivalent to one to three times the value of the cargoes, and the cargoes shallbe confiscated.” In the above paragraph, “confiscated” means:
