【評論內容】在法律授權的範圍內行使裁量權這種例子在「道路交通管理處罰條例」裡有很多比如第34條:汽車駕駛人，連續駕車超過八小時經查屬實，或患病足以影響安全駕駛者，處新臺幣1200元以上2400百元以下罰鍰，並禁止其駕駛...其中1200~2400元就是裁量空間，由執法人員視實際狀況輕重來決定要罰多少不能因為是熟人所以罰低於1200，不可以看違規人特別不順眼就罰超過2400 所以是依法行政
